Contracts are everywhere in your business. You negotiate them with suppliers, customers, consultants, employees, shareholders, investors, creditors, and more. Some of the agreements that a business encounters in these relationships should be reduced to writing and reviewed by an attorney. It is not always enough for upper management or an experienced salesman to review the final terms of a contract before it is agreed upon by the parties. Most of the time business relationships are conducted without the need of a written contract either: because both parties end up performing their half of the bargain with no breach in performance, or because both parties operate without a written contract and performance is adequate for both parties. In all other cases, a written contract can be a life saver, particularly if it sets out what remedies each party gets for a breach in performance, how those remedies are determined, and the process by the which these matters are resolved.
